Nearly two years after an Antrim County teenager died from a gun-shot wound in his home, police now believe the know who killed him: his own mother.
In a stunning development, a judge issued an indictment, charging Anne Avery-Miller with Killing her son, Samuel. Police arrested Avery-Miller this morning at her boyfriend's house in Traverse City. Samuel Avery died in November of 2007 in the home he shared with his mother in Elk Rapids. She originally told police it was suicide. Two months after his death, Anne disappeared while on bond for an assault charge. She turned herself in about a month later, claiming she went to a domestic shelter in Nevada. She later made a plea deal and was sentenced to three months in jail for fraud. This past August, investigators ruled her son's death as homicide. Antrim County Prosecutor, Charley Koop, denied our repeated requests for an interview, but in a news release, says he sought a one-person grand jury because investigators were unable to get key information. Through court records, we learned some of that key information includes testimony from a patient at a mental health facility where Anne briefly stayed after her son's death. The patient testified in court that Anne confessed to her that she shot and killed her son. Court records also show that investigators found Anne's journal that allegedly contained plans to kill her kids and herself. The judge ruled all of this was enough to charge Anne Avery-Miller with her son's murder. Avery-Miller's attorney, Carl Marlinga, says he has not yet received any of the evidence presented to the grand jury. "We will be able to better assess the case when we receive all the information," he said.
